A federal statute -- the Help Our Families Act -- provides economic support for low-income families that are raising children. As part of its mandates under the HOFA, the Department of Housing and Urban Development must issue "program eligibility guidelines" stating which families are eligible for housing-assistance grants. The grants are provided by the federal government and can be used in private housing. One of the program eligibility guidelines is whether an applicant "belongs to a racial group that has historically suffered from housing discrimination by local zoning boards." Would a court likely conclude that this eligibility guideline is constitutional?
